The ICAI has thankfully given detailed rules as to how to go about these transfers without disturbing your exam schedule. Do not adopt a casual and messy approach of simply walking out of your current firm before you get formal approval, as such actions may create compliance problems and affect your final exam eligibility. CA Articleship Transfer Rules: Mandatory Minimum Service Period Requirements
To ensure continuity of professional learning, the ICAI provides a period for the article to serve his or her tenure with his or her original principal before moving on to a voluntary transfer. The only exceptions that can permit a transfer before the specified period are misconduct of the principal or the closure of a firm.
This measure is to prevent the entire three-year training from being treated as casual work. The time limits, institutional structures, and operation framework clauses are changing all the time. How to Transfer: A Step-by-Step Guide
If you have a case that qualifies under regulations and you meet all conditions, simply follow these easy steps for a successful transition:
STEP 1: PROFESSIONAL ONE-ON-ONE TALK
1. Have a professional discussion with your current principal. Most principals will cooperate if students clearly state and justify their reasons for the transition before starting the formal procedure.
STEP 2: GET FORM 109/NOC
Get a signed no-objection certificate or termination form from your current principal. This will be a certification of your completed period of training and the professional closing from their side.
STEP 3: GET THE NEW PRINCIPAL TO ACCEPT YOU
Please arrange a time to meet with the new proposed principal. Get your slot fixed with the new proposed Principal. Ensure that the new principal is available for another articled assistant (the current number must be below the principal’s regulatory quota) and ready for your joining.
STEP 4: APPLICATION ON SSP PORTAL
Log in to the official ICAI SSP account, click on articleship, and fill out the transfer forms. Upload all the necessary documents, like the termination documents from the old firm, the acceptance letter from the new firm, and the documents supporting your transfer.
STEP 5: PAY REGULATORY TRANSFER CHARGE
Pay the required fee for processing your articleship transfer via the payment portal.
